Eco Giving Affiliate Program Terms of Service

Agreement

By signing up to be an Affiliate in the Eco Giving Affiliate Program (“Program”) you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

Eco Giving reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Program, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Program after any such changes shall constitute your consent to such changes.

Violation of any of the terms below will result in the termination of your Account and for forfeiture of any outstanding affiliate commission payments earned during the violation. You agree to use the Affiliate Program at your own risk.

Account Terms

  • You must be 18 years or older to be part of this Program.
  • You must live in the United States to be an Affiliate.
  • You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
  • You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
  • Your login may only be used by one person – a single login shared by multiple people is not permitted.
  • You are responsible for maintaining the security of your account and password. Eco Giving cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You are responsible for all Content posted and activity that occurs under your account.
  • One person or legal entity may not maintain more than one account.
  • You may not use the Affiliate Program for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
  • You may not use the Affiliate Program to earn money on your own Eco Giving product accounts.

Links/graphics on your site, in your emails, or other communications

Once you have signed up for the Affiliate Program, you will be assigned a unique Affiliate Code. You are permitted to place links, banners, or other graphics we provide with your Affiliate Code on your site, in your emails, or in other communications. We will provide you with guidelines, link styles, and graphical artwork to use in linking to Eco Giving. We may change the design of the artwork at any time without notice, but we won’t change the dimensions of the images without proper notice.

To permit accurate tracking, reporting, and referral fee accrual, we will provide you with special link formats to be used in all links between your site and the Eco Giving. You must ensure that each of the links between your site and the Eco Giving properly utilizes such special link formats. Links to the Eco Giving placed on your site pursuant to this Agreement and which properly utilize such special link formats are referred to as “Special Links.” You will earn referral fees only with respect to sales on a Eco Giving product occurring directly through Special Links; we will not be liable to you with respect to any failure by you or someone you refer to use Special Links or incorrectly type your Affiliate Code, including to the extent that such failure may result in any reduction of amounts that would otherwise be paid to you pursuant to this Agreement.

Affiliate links should point to the page of the product being promoted.

Referral fees/commissions and payment

For a Product sale to be eligible to earn a referral fee, the customer must click-through a Special Link from your site, email, or other communications to https://ecogiving.org and complete an order for a product during that session.

We will only pay commissions on links that are automatically tracked and reported by our systems. We will not pay commissions if someone says they purchased or someone says they entered a referral code if it was not tracked by our system. We can only pay commissions on business generated through properly formatted special links that were automatically tracked by our systems.

We reserve the right to disqualify commissions earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods.

Payments only begin once you’ve earned more than $20 in affiliate income. If your affiliate account never crosses the $20 threshold, your commissions will not be realized or paid. We are only responsible for paying accounts that have crossed the $20 threshold.

Identifying yourself as a Eco Giving Affiliate

You may not issue any press release with respect to this Agreement or your participation in the Program; such action may result in your termination from the Program. In addition, you may not in any manner misrepresent or embellish the relationship between us and you, say you develop our products, say you are part of Eco Giving or express or imply any relationship or affiliation between us and you or any other person or entity except as expressly permitted by this Agreement (including by expressing or implying that we support, sponsor, endorse, or contribute money to any charity or other cause).

You may not purchase products through your affiliate links for your own use. Such purchases may result (in our sole discretion) in the withholding of referral fees and/or the termination of this Agreement.

Payment schedule

As long as your current affiliate earning are over $20, you’ll be paid each month. If you haven’t earned $20 since your last payment, we’ll pay you the following month after you’ve crossed the threshold.

Customer definition

Customers who buy products through this Program will be deemed to be our customers. Accordingly, all of our rules, policies, and operating procedures concerning customer orders, customer service, and product sales will apply to those customers. We may change our policies and operating procedures at any time. For example, we will determine the prices to be charged for products sold under this Program in accordance with our own pricing policies. Product prices and availability may vary from time to time. Because price changes may affect Products that you have listed on your site, you should not display product prices on your site. We will use commercially reasonable efforts to present accurate information, but we cannot guarantee the availability or price of any particular product.

Your responsibilities

You will be solely responsible for the development, operation, and maintenance of your site and for all materials that appear on your site. For example, you will be solely responsible for:

– The technical operation of your site and all related equipment
– Ensuring the display of Special Links on your site does not violate any agreement between you and any third party (including without limitation any restrictions or requirements placed on you by a third party that hosts your site)
– The accuracy, truth, and appropriateness of materials posted on your site (including, among other things, all Product-related materials and any information you include within or associate with Special Links)
– Ensuring that materials posted on your site do not violate or infringe upon the rights of any third party (including, for example, copyrights, trademarks, privacy, or other personal or proprietary rights)
– Ensuring that materials posted on your site are not libelous or otherwise illegal
– Ensuring that your site accurately and adequately discloses, either through a privacy policy or otherwise, how you collect, use, store, and disclose data collected from visitors, including, where applicable, that third parties (including advertisers) may serve content and/or advertisements and collect information directly from visitors and may place or recognize cookies on visitors’ browsers.

Compliance with Laws

As a condition to your participation in the Program, you agree that while you are a Program participant you will comply with all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions or other requirements of any governmental authority that has jurisdiction over you, whether those laws, etc. are now in effect or later come into effect during the time you are a Program participant. Without limiting the foregoing obligation, you agree that as a condition of your participation in the Program you will comply with all applicable laws (federal, state or otherwise) that govern marketing email, including without limitation, the CAN-SPAM Act of 2003 and all other anti-spam laws.

Term of the Agreement and Program

The term of this Agreement will begin upon our acceptance of your Program application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this Agreement for any reason, you will immediately cease use of, and remove from your site, all links to https://ecogiving.org, and all of our trademarks, trade dress, and logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with the Program. Eco Giving reserves the right to end the Program at any time. Upon program termination, Eco Giving will pay any outstanding earnings accrued above $20.

Termination

Eco Giving, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Program, or any other Eco Giving service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all potential or to-be-paid commissions in your Account if they were earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods. Eco Giving reserves the right to refuse service to anyone for any reason at any time.

Relationship of Parties

You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Section.

Limitations of Liability

We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under this Agreement.

Disclaimers

We make no express or implied warranties or representations with respect to the Program or any products sold through the Program (including, without limitation, warranties of fitness, merchantability, noninfringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of the Eco Giving will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Independent Investigation

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

Arbitration

Any dispute relating in any way to this Agreement (including any actual or alleged breach hereof), any transactions or activities under this Agreement or your relationship with us or any of our affiliates shall be submitted to confidential arbitration, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court (and you consent to non-exclusive jurisdiction and venue in such courts) or any other court of competent jurisdiction. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Miscellaneous

This Agreement will be governed by the laws of The United States, without reference to rules governing choice of laws. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

The failure of Eco Giving to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Eco Giving and govern your use of the Service, superceding any prior agreements between you and Eco Giving (including, but not limited to, any prior versions of the Terms of Service).

  1. About These Sales Terms

 

These Sales Terms are applicable to all orders and purchases made via EcoGiving.org website, Facebook, Instagram and Pinterest. EcoGiving.org may revise these Sales Terms from time to time. Any changes to the Sales Terms will apply on or after the date that the revised Sales Terms are published. You are advised to check this page from time to time to take notice of any changes, as they are binding on you.

 

EcoGiving.org offers products for sale via EcoGiving.org website to consumer customers. EcoGiving.org reserves the right to not fulfil orders placed by non-consumers or by individuals who fail to comply with these terms.

 

 

With regard to purchases made by you via EcoGiving.org website, EcoGiving.org will usually communicate with you electronically by email, using the email address provided to EcoGiving.org when you place an order or otherwise communicate with EcoGiving.org. You may still contact us using one of the methods referred to in section 17 (Contact Details) below or by using the contact details on EcoGiving.org website.

 

 

BEFORE PLACING AN ORDER FOR PRODUCTS YOU MUST READ AND AGREE TO BE BOUND BY THESE SALES TERMS.

 

YOUR ATTENTION IS DRAWN IN PARTICULAR TO THE PROVISIONS OF SECTION 15 (LIABILITY). IF YOU FIND YOURSELF UNABLE TO AGREE TO THESE SALES TERMS YOU MAY NOT PROCEED TO PURCHASE ANY PRODUCTS LISTED ON ECOGIVING.ORG WEBSITE.

 

  1. Your account

 

If you create an account (personal user identification or username) on the EcoGiving.org website, you are responsible for maintaining the confidentiality of your username and password and for restricting access to your password.

 

By creating an account, you agree to accept responsibility for all activities and purchases that occur under your account, unless those activities or purchases are carried out by an unauthorised third party who has gained access to your account other than by reason of your negligence or carelessness.

 

EcoGiving.org makes no guarantee that EcoGiving.org website or your account will be error free or secure from bugs or viruses. You are responsible for your own information technology and security and you should use your own virus protection software. Please tell us immediately if your account or payment details have been lost or stolen. If we become concerned about the security of your account we may block access and usage.

 

  1. Placing an Order

 

To be able to buy Products you must:

 

  • read and accept these Sales Terms;
  • provide your name and address, phone number, email address, payment details and other required information;
  • provide an eligible delivery address
  • be legally capable of entering into binding contracts; and
  • be the owner or authorised holder of a valid debit/credit card, (see section 6 (Payment) for details of the payment methods accepted on EcoGiving.org website).

 

You may place an order by clicking on the “ADD TO CART” button and proceeding to the checkout page.

 

At the checkout page you will be provided with an opportunity to review your order(s), read and accept these Sales Terms, check the total price of your order(s) and the information you have provided, and correct any input errors before confirming your order(s).

 

You must check and ensure that your delivery address is correct before placing your order as it may not be possible to change your address before the order is dispatched. Please see section 4 (Order Processing) below which deals with this in more detail.

 

EcoGiving.org website currently ships to all addresses within Great Britain, Northern Ireland, Germany, Spain, France, Benelux and Switzerland excluding hotels, hostels, prisons, P.O. Boxes and BFPO (British Forces Post Office) addresses. We do not currently deliver to Channel Islands.

 

  1. Order Processing and Contract Formation

 

Once you have submitted your order(s) using EcoGiving.org website, EcoGiving.org will send you an email acknowledging receipt of your order(s) (“Order Receipt Confirmation”) and setting out details of the ordered Product(s).

 

EcoGiving.org may not always be able to accept your order and EcoGiving.org may choose not to accept your order in its sole discretion. For example (without limitation) there may be pricing errors, insufficient stock, unusual orders or orders which EcoGiving.org suspects are not placed in good faith. There may also be unexpected events outside of our control meaning we may be unable to fulfil your order.

 

If your order is not accepted EcoGiving.org will inform you via email, and if any payment has already been taken you will be reimbursed in full for any sums paid to EcoGiving.org for that order.

 

After receiving your order(s), EcoGiving.org will check that the relevant Product(s) is/are in stock. A contract for the sale of Products between you and EcoGiving.org, which will be governed by these Sale Terms, will only be formed when EcoGiving.org emails you confirming that all or part the Product(s) is/are still available and has/have been dispatched (“Shipment Confirmation”).

 

 

 

The contract is formed upon EcoGiving.org sending the Shipment Confirmation to you at the email address provided with your order. Please contact EcoGiving.org’s Customer Care Team if you have not received your Shipment Confirmation within 72 hours of placing your order.

 

A contract for the sale of Products will relate only to those Products whose dispatch has been confirmed in the Shipment Confirmation. EcoGiving.org will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Shipment Confirmation.

 

In the Order Receipt Confirmation you will receive a copy of these Sales Terms, however you are encouraged to download, save and/or print a copy of your Order Receipt Confirmation and these Sales Terms for your records.

 

If you would like to amend or cancel your order before you have received your Shipment Confirmation, you must contact the EcoGiving.org Customer Care Team as soon as possible using one of the methods set out in section 17 (Contact Details) or as otherwise set out in the Order Receipt Confirmation. It may not be possible to amend or cancel your order, or to prevent dispatch of the Products, due to the speed with which orders are processed. If EcoGiving.org is unable to amend or cancel your order and the Products are dispatched to you, you have the option of either refusing to accept the delivery, in which case the Products will be returned to EcoGiving.org, or accepting the delivery and then returning the Products to EcoGiving.org in accordance with section 12 (Returns and Refunds).

 

Once you have received your Shipment Confirmation, it will be too late to prevent the Products from being dispatched to you. If you would like to cancel your order after this point, please see section 12 (Returns and Refunds) below.

 

  1. Prices, Shipping and Handling, Charges and Taxes

 

The price charged for a Product will be the price in effect at the time your order is placed and will be set out in the Order Receipt Confirmation and in your Shipment Confirmation.

 

In the event of a pricing error, whether on EcoGiving.org website or in an Order Receipt Confirmation or otherwise, you accept that EcoGiving.org has the right to correct such error and charge the correct price or cancel the order. If the actual price is more than the amount shown on your Order Receipt Confirmation, EcoGiving.org will notify you of the correct price and give you the option of proceeding with the order or cancelling it. If we are unable to contact you or if we do not receive a response from you, your order will be cancelled and any amounts paid by you to EcoGiving.org for the Products will be reimbursed. If you do not want to proceed with your order your sole remedy in the event of such a pricing error is to cancel your order.

 

You acknowledge that even after EcoGiving.org has sent you the Shipment Confirmation, if the pricing error is obvious and could reasonably have been recognised by you as an error, then EcoGiving.org will be under no obligation to provide the relevant Product(s) to you at the incorrect price.

 

Prices for the Products include VAT and/or other applicable taxes but do not include charges for shipping and handling. Separate charges for shipping and handling (and their related VAT or other taxes) will be clearly displayed on the screen prior to the completion of your order and will be confirmed in your Order Receipt Confirmation.

 

Prices for Products and for shipping and handling are liable to change at any time, but changes will not normally affect orders in respect of which we have already sent you a Shipment Confirmation (save in the case of a manifest pricing error as described above).

 

  1. Payment

 

Payment shall be made by one of the methods you have selected during the checkout process (being VISA, MasterCard, Maestro).

 

Approved credit and debit card types are listed at EcoGiving.org website checkout. In the event EcoGiving.org does not receive the appropriate authorisation from your card or payment service provider, EcoGiving.org reserves the right to reject your order.

 

Payment for your order, including all applicable taxes, shipping and other charges, will be settled from the applicable card or payment service once EcoGiving.org has sent you the Shipment Confirmation.

 

  1. Delivery

 

You should allow up to 10 days (excluding Sunday and bank holidays) for standard delivery. Delivery shall in any event take place within 30 days after EcoGiving.org has sent you the Shipment Confirmation. EcoGiving.org reserves the right to substitute another carrier of equal or lesser cost to deliver your order. The delivery options described above are the only shipping options available for sales through EcoGiving.org website. EcoGiving.org is unable to accept any special delivery requests, which are outside the scope of these two options.

 

If EcoGiving.org cannot deliver your order within the period specified in your Shipment Confirmation, EcoGiving.org will notify you as soon as possible. You may choose to cancel your order, in which case EcoGiving.org will provide you with a full refund. If you choose not to cancel your order, EcoGiving.org will endeavour to deliver your order within a reasonable period of time.

 

If you unreasonably defer delivery or delay the receipt of delivery after EcoGiving.org has notified you that the carrier has tried to deliver the ordered items to you, or if you have provided EcoGiving.org with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to EcoGiving.org, your order will be cancelled and a full refund will be issued to you.

 

  1. Events Outside the Control of EcoGiving.org

 

EcoGiving.org shall not be held responsible for delay or failure to perform, if the delay or failure is caused by any act, event, non-happening, omission, accident or circumstance beyond its reasonable control, including, but not limited to:

 

  • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • strikes or lock-outs (or other industrial action);
  • national or local states of emergency;
  • interruption or failure of communication or transportation facilities;
  • power or utility outages;
  • non-performance by suppliers or subcontractors (other than by companies in the same group of companies as EcoGiving.org);
  • earthquake, fire, explosion, storm, flood, subsidence, epidemic or other natural disaster;
  • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • the acts, decrees, legislation, regulations or restrictions of any government.

 

In such circumstances, EcoGiving.org will notify you and take reasonable steps to minimise any delay. The time for EcoGiving.org’s performance of its obligations is deemed to be extended for the period that any of the above continues. If EcoGiving.org is unable to fulfil your order because of any circumstances outside of its control, or if there is a substantial delay to our delivering your order, you may cancel your order and obtain a full refund.

 

  1. Product Availability

 

EcoGiving.org uses reasonable efforts to ensure the availability of Products you order from EcoGiving.org website. However, Products are made available to purchase on a “first in-first out” basis and are only available while stocks last.

 

  1. Compatibility, Product Information

 

Please take care when placing your order to ensure that the Products you purchase are compatible for the intended use. Please use EcoGiving.org website as your final point of reference when checking compatibility. In the event of a difference between EcoGiving.org website content and any other website (or any other source of information) the compatibility of Products as shown on EcoGiving.org website at the time of purchase will be seen as taking precedence.

 

Images on EcoGiving.org website may vary depending on your device’s display quality. Whilst every effort is made to reproduce images of the Products in the most accurate way possible, these images are for illustrative purposes only and your Products may vary from those images for example, in colour, size, pattern and texture. The packaging of Products may also vary from that shown in images on EcoGiving.org website.

 

If the Products you have received do not correspond to the ones you have ordered, or if your delivery is incomplete or damaged in transportation, please contact EcoGiving.org Customer Care Team for assistance without delay, either via email or by phone.

 

  1. Title to Products

 

Ownership of the Products will pass to you only when EcoGiving.org has received full payment in respect of your order, including all taxes, shipping and other charges. The Products will be at your risk from the time of delivery.

 

  1. Return and Refund

 

Cancellations under the Consumer Contracts Regulations

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Consumer Contracts Regulations”), you have a legal right to cancel your purchase during the cancellation period. The cancellation period begins on the date that the contract is formed (when EcoGiving.org sends you the Shipment Confirmation) and continues until the end of 14 days starting on the day after you receive the Product. This cancellation right applies to both sale and non-sale Products but does not apply to Excluded Products as set out below. If the Product has been dispatched to you before you cancelled the purchase, you must return the Product to EcoGiving.org within 14 days starting on the day after you cancel the order. If you wish to cancel your purchase under the Consumer Contracts Regulations, you can use EcoGiving.org website’s Returns Process.

 

You can cancel your order by contacting the Customer Care Team either by using the Contact Us form or by telephone on +44 0333 210 0280.

 

If you cancel your purchase under the Consumer Contracts Regulations, EcoGiving.org will refund to you the full price you paid for the Product (including all VAT and/or other taxes) together with delivery costs you have paid, although, as permitted by law, the maximum delivery costs refunded will be the cost of the standard delivery service.

 

Once EcoGiving.org has received and validated your returned Product, EcoGiving.org will send you an email to confirm the validation. Any refund due to you will be made as soon as possible and in any event within the period of 14 days after the day on which EcoGiving.org receives the Product back from you or, if earlier, the day on which you provide EcoGiving.org with evidence that you have sent the Product back to EcoGiving.org. If the Product was not dispatched to you, you will be refunded within the period of 14 days after you inform EcoGiving.org of your decision to cancel the purchase. EcoGiving.org will refund you by the same method you used to make payment.

 

EcoGiving.org is entitled by law to reduce your refund to reflect any reduction in the value of the Product, if this has been caused by your handling it in a way which would not be permitted in a shop. If EcoGiving.org refunds the price paid before it has an opportunity to inspect the Product and later discovers you have handled it in an unacceptable way or damaged it, you must pay EcoGiving.org an appropriate amount.

 

Returns under the EcoGiving.org website enhanced cancellation policy

In addition to your rights under the Consumer Contracts Regulations, if for any reason you are not completely satisfied with your purchase from EcoGiving.org website, you can return non-sale Products purchased from EcoGiving.org website within 30 days of receipt of the Products for a refund, but to do so you must follow the Returns Process

 

Once EcoGiving.org has received and validated any returned Products, EcoGiving.org will send you an email to confirm the validation. Your refund will be processed within 14 (fourteen) days of EcoGiving.org’s email to you confirming the receipt and validation of your returned Product.

 

Any Product returned under the EcoGiving.org website enhanced cancellation policy must be in a new, unworn and resalable condition and EcoGiving.org reserves the right to refuse a refund where the Product is returned damaged or showing signs of use or wear.

 

Please note that these enhanced return rights do not apply to sale Products or to any Excluded Products. This does not affect your rights in law as a consumer including your right to return products under the Consumer Contracts Regulations and your right to return faulty products under the Consumer Rights Act 2015.

 

Excluded Products

 

EcoGiving.org website does not accept returns or exchanges of: any bespoke or customised products.

 

 

 

Returning Products that are faulty or not as described

If you need to return any Product because you believe it is faulty or not as described, but the deadline for returning the Product under the Consumer Contracts Regulations and EcoGiving.org website enhanced cancellation policy (if applicable) have expired, you must contact the Customer Care Team for further assistance before returning your product, by by using our contact us form.

 

Once you have returned your Product in accordance with our instructions and your refund has been approved by EcoGiving.org, EcoGiving.org will refund in full the price of Products (including sale Products) that are faulty or not as described, together with all applicable delivery charges (including any premium paid for non-standard delivery), and any reasonable costs you incur in returning the item.

 

Exceptions

 

If you do not return a Product (or, if a Product sent using the Returns Process fails to arrive and you are unable to provide proof of postage), EcoGiving.org reserves the right to refuse a refund.

 

Promotions

 

If you participate in a EcoGiving.org promotion additional terms apply.

 

  1. Consumer Warranty (Guarantee)

 

THIS GUARANTEE GIVES YOU SPECIFIC RIGHTS. IT IS OFFERED AS AN ADDITIONAL BENEFIT TO YOUR RIGHTS UNDER LAW. YOU ALSO HAVE OTHER RIGHTS UNDER LAW WHICH MAY VARY FROM COUNTRY TO COUNTRY.

 

You can find out about your legal rights and remedies by contacting your local consumer advice service. In particular, EcoGiving.org website has a legal duty to supply products that conform to the contract made with you. Nothing in this Guarantee will replace or lessen any of your legal rights or remedies.

 

Products sold by EcoGiving.org website include a guarantee for Products that are faulty or not as described during the periods set out below for various Product types:

  • 6 months from the original date of purchase for EcoGiving.org

 

This means you can request a repair or replacement free of charge if the Products turn out to be faulty or not as described during this period. EcoGiving.org will repair your Product or replace it with a Product of identical or similar characteristics, except as set out below. EcoGiving.org may at its own discretion replace your Product under this Guarantee whether or not a repair of your original Product is possible. If EcoGiving.org chooses instead to repair your Product EcoGiving.org may do so with new or refurbished components.

 

If your Product is faulty or not as described but you do not want EcoGiving.org to repair or replace your Product, you may have a legal right to reject the Product and receive a refund. Please see ‘Returning Products that are faulty or not as described’ (above) for further details about how to return Products to EcoGiving.org that are faulty or not as described.

 

If the Product cannot be repaired or replaced within a reasonable time or without inconvenience, you may request a refund or price reduction. Refunds, if authorised, will usually be made using the same payment method originally used by you to pay for your purchase.

 

Please retain your Order Receipt Confirmation or pass it on to the gift recipient as the original proof of purchase is the warranty under which this Guarantee operates. If the Order Receipt Confirmation is not available, a credit card or bank statement showing the relevant transaction will suffice. This does not affect your rights in law as a consumer.

 

This Guarantee does not cover normal wear and tear or damage caused by accidents, mishandling, improper use (such as knocks, dents, crushing etc.).

 

Repairs (or attempted repairs) to Products other than by EcoGiving.org will void this Guarantee whether or not damage has been caused by such repair or attempted repair.

 

If your Product is repaired or replaced by EcoGiving.org under this Guarantee, the new item will benefit from the remainder of the term of this Guarantee (calculated from the date of the original purchase of the Product). The period of this Guarantee shall not be extended whether or not your Product is repaired or replaced.

  

  1. Liability

 

EcoGiving.org warrants to you that any Product purchased from EcoGiving.org website is of satisfactory quality and fit for all the purposes for which products of the same kind are commonly supplied.

 

EcoGiving.org is only liable for foreseeable loss and damage. EcoGiving.org is not responsible for any loss or damage that is not foreseeable. HOWEVER NOTHING IN THESE SALES TERMS AFFECTS YOUR LEGAL RIGHTS AS A CONSUMER. TO THE FULL EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ECOGIVING.ORG AND ECOGIVING.ORG SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID FOR THE PURCHASE OF THE APPLICABLE PRODUCTS PLUS DELIVERY FROM ECOGIVING.ORG WEBSITE.

 

In particular, nothing in these Sales Terms excludes or limits in any way the liability of EcoGiving.org:

  • for death or personal injury caused by EcoGiving.org’s negligence;
  • for fraud or fraudulent misrepresentation;
  • under section 2(3) of the UK’s Consumer Protection Act 1987 or for any breach of your consumer rights relating to products; or
  • for any matter for which it would be illegal for The Truly Collection to limit or exclude, or attempt to limit or exclude, liability.

 

  1. Severability

 

If any provision of these Sales Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable (deleted) from these Sales Terms and this will not affect the validity and enforceability of any remaining provisions.

These Sales Terms are binding on you and EcoGiving.org. It will also be binding on any person or organisation to which EcoGiving.org might transfer its rights and obligations to.

 

You may not transfer or otherwise dispose of your contract with EcoGiving.org, or any of your rights or obligations arising under it, without EcoGiving.org’s prior written consent.

 

EcoGiving.org may transfer or otherwise dispose of a contract with you, or transfer any of EcoGiving.org’s rights or obligations arising under it, at any time. If you have an outstanding order with EcoGiving.org at the time of any such disposal or transfer, you will be contacted if EcoGiving.org and you may cancel your outstanding order if you do not want to proceed.

 

  1. Third Party Rights

 

Other than EcoGiving.org, any person who is not a party to the contract between you and Pandora is not entitled to enforce any of its terms.

 

  1. Intellectual Property Rights

 

The content on the EcoGiving.org website including all copyright, trade marks and other intellectual property rights it contains, including the name EcoGiving.org is the sole property of EcoGiving.org or its licensors.

 

  1. Data Protection

 

EcoGiving.org believes strongly in protecting user privacy and personal data. Any personal data collected and processed by EcoGiving.org is governed by EcoGiving.org’s privacy policy . Please read EcoGiving.org’s privacy policy for further information on how The Truly Collection processes personal data collected from users of EcoGiving.org website.

 

  1. Waiver

 

If EcoGiving.org fails, at any time, to insist that you comply with your obligations under these Sales Terms, or if EcoGiving.org does not exercise any of its rights under these Sales Terms, this does not constitute a waiver of such rights and does not mean that you are free to ignore your obligations. EcoGiving.org can still require you to comply at a later date.

 

  1. Entire Agreement

 

These Sales Terms and any document that we have referred to within them (including via hyperlink) represent the entire agreement between EcoGiving.org and you and takes precedence over any other previous agreement or representation made to you whether oral or in writing.

You acknowledge that, in entering into a contract with EcoGiving.org, you have not relied on any representation or promise given by EcoGiving.org or anyone else except as set out in these Sales Terms.

 

  1. Governing Law and Jurisdiction

 

These Sales Terms and your purchase of Products from EcoGiving.org through EcoGiving.org website shall be governed by and construed in accordance with the laws of England.

Any dispute or claim arising out of or in connection with these Sales Terms or your purchase of Products from EcoGiving.org (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the English courts. If you are a resident of Northern Ireland, Scotland or Wales you may also bring proceedings in your local courts.
